CONTRACTUAL RELATIONSHIP

These Terms of Use ("Terms") govern the access or use by you, an individual, of applications, websites, content, products and services (the "Services") made available by Libellula di Martina Bodini , an individual company incorporated in Italy, with headquarters in, Corso di Porta Romana, 74, 20122, Milan, registered with the Milan Chamber of Commerce with REA number MI-2544310.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

 

Access to and use of the Services constitutes your acceptance to be bound by these Terms, and thereby establishes a contractual relationship between you and Libellula. If you do not agree to these Terms, you will not be able to access or use the Services. These Terms expressly supersede any prior agreement or understanding with you. Libellula may immediately terminate these Terms or the Services used by you, or in general terminate the offer or deny access to the Services or part thereof, at any time and for any reason.

Libellula may modify the Terms relating to the Services from time to time. The changes will take effect with the publication by Libellula of such updated Terms on this site or of the modified policies or of the additional Terms on the applicable Services. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

The collection and use of personal data in relation to the Services complies with the provisions of the Libellula Privacy Policy.

 

Our services

On the website www.rawfleurs.it it is possible to buy floral bouquets; delivered by Libellula or by subjects appointed by the latter in the Milan area. Some products require longer delivery times.

All the Libellula bouquets displayed in the catalogs are made by Libellula using quality and extremely fresh flowers and plants. and use a seasonal product subject to natural changes. Consequently, the photos are for illustrative purposes only.

 

Third Party Services and Content

The Services may be made available or accessible in connection with the services and content of third parties (including advertising), which Libellula does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third party services and content. Libellula does not endorse such third-party services and content and in no case Libellula will be responsible for the products or services of such third-party suppliers.

 

Property

The Services and all related rights are and will remain the property of Libellula, or their respective licensors. Neither these Terms nor your use of the Services transfer or attribute to you any rights: (i) in relation to the Services, except under the limited license granted above or (ii) to use or refer in any way to the names company, logos, product or service names, trademarks, or service marks of Libellula or those of Libellula's licensors.

 

Order and Payment

Once the destination has been identified, the customer can choose the product that meets his needs compatibly with the desired delivery date.

You can add a text to the ticket that will eventually accompany the selected product. Alternatively, you can use one of the texts we have selected for each occasion.

He will have to provide some personal data and he will have to accurately enter the recipient's data paying the utmost attention to the correct insertion of the information necessary to guarantee the success of the order.

The insertion of the data indicated above is necessary for sending the invoice and for the correct execution of the order.

The Parties do not intend to attribute to the insertion of the data indicated above the value of the customer's consent to legitimize Libellula to act also in the name of the customer.

Finally, to complete the order, in compliance with the provisions of art. 1719 of the civil code, you will have to make the payment by credit card online: it will be sufficient to enter your card details (type of card, number, expiry date and if necessary the control code). The transaction will be handled entirely by Stripe ensuring the highest levels of security.

 

Promotional Codes

Libellula may, at its sole discretion, create promotional codes that can be redeemed as discount coupons. You acknowledge that Promotional Codes: (i) must be used for the intended recipients and purpose, and lawfully (ii) may not be duplicated, sold or transferred in any way, or made available to the general public (published in a form accessible to the public or otherwise), unless explicitly authorized by Libellula (iii) can be disabled by Libellula at any time, for any reason, without any liability to Libellula (iv) can only be used in accordance with the specific terms that Libellula establishes for this Promotional Code (v) are not valid as a form of liquidity and (vi) could expire before being used. Libellula reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promotional Codes by you or any other user in the event that Libellula determines or believes that the use or refund of the Promotional Code was due. in error, fraudulent, illegal, or in violation of the terms of the applicable Promotional Code or these Terms.

 

Prices

The prices indicated in the Libellula online catalog next to each product are inclusive of VAT.

The prices indicated include product fees, deliveries and credit card payment fees.

In the event that the recipient refuses, without a plausible reason, the flowers delivered by our florist, the latter will still have the right to be paid in full for the empty delivery.

 

Delivery and flower supply conditions:

The delivery of fresh flowers can only be made during the days and times indicated on the site.

Delivery throughout Italy from Monday to Friday at a cost of € 6.00. Delivery within  an approximate term ranging from one to five (1-5) working days from the moment it leaves Libellula's warehouses. The customer assumes the risk relating to deterioration, damage, damage and loss of the products starting from the time of delivery of the same in accordance with the procedure established in these Terms and Conditions. The customer is responsible for the storage and conservation of the products according to the conditions, if any, indicated on the labeling.

Exceptions:

  • Orders required for the following holidays: Valentine's Day; Women's Day; Easter; Mother's Day; Christmas; New Year's Eve, considering the expected volume of deliveries, can be delivered the day before or after the scheduled date.

  • No deliveries are made to campsites, military bases, boats, port areas and airports.

The delivery is considered duly completed with the signature and indication of the name of the personnel responsible for receiving the delivery affixed to the due receipt.

If Libellula or the courier in charge does not find the recipient or a person appointed by him to receive the order, the order must return to our laboratory. In this case we leave a note or a message to schedule another delivery, it being understood that the longer the flower remains in the boxes, the more it will lose its quality of freshness. After an unsuccessful delivery attempt, delivery is no longer guaranteed and a new order may be required.

Libellula assumes no responsibility if the order is not fulfilled due to the data provided by the user being false, incorrect or incomplete or for reasons beyond the scope of responsibility of the delivery agency, such as the absence of the user.

Shipping times are approximate. However, Dragonfly does everything possible to respect them.

Orders to be delivered in public or large places such as hospitals, hotels, residences, businesses, universities or public buildings need very detailed information otherwise we will not be able to guarantee delivery. For example, in the space dedicated to the notes, provide your name, telephone number, details of the relevant office and opening hours to the public. We will try to deliver your bouquet in accordance with the regulations of each building, however we cannot be held responsible if these organizations prevent it. Libellula cannot authorize any refund in the event that an order could not be delivered due to the circumstances described above.

Correctness of the recipient's address

Please check that the given address and telephone number are correct and complete. We cannot take any responsibility for delays or non-deliveries as a result of incorrect or incomplete information. To allow the courier to execute the order on time and without problems, it is advisable to provide the following additional information:

  • In case of hospital delivery, if possible indicate the ward and room number.

  • In case of delivery to a hotel, please indicate the room number and the name under which the recipient or recipient is registered with the hotel.

 

Order confirmation

For each order, you will receive a confirmation via e-mail within a few minutes containing the order number as well as detailed information regarding the product purchased, the price, the delivery date and the sender's and recipient's addresses.

If you do not receive an order confirmation, please contact customer service by sending an email to hello@rawfleurs.com.

 

Warranty

We assure you that all your orders will be carried out with competence and quality and that the flowers and arrangements will be delivered fresh. Our guarantee includes:

  • the quality and the absolute freshness of the product

  • delivery for the requested day

  • the price published on the site

For any type of complaint, please write to the e-mail address ciao@rawfleurs.com no later than 48 hours from the delivery date.

 

Cancellation / right of revocation of the order

An order of fresh flowers or dried flowers cannot be refunded, in the case of cancellation of the order, no later than three working days from the scheduled delivery date, a voucher of the same amount will be issued which can be used within one year of issue. After this date, the issuance of the voucher is not guaranteed and the full amount will be charged. Due to the nature of the products it is not possible to make returns.

A ceramic order can be returned and refunded after checking the integrity of the object within 15 days of receipt by the recipient. Once the return has been agreed, Libellula will communicate the shipping address. The costs of the return are charged to the customer. Within 7 working days the customer will receive the refund on his payment method, the refund is intended for the entire order or the returned products and shipping costs are excluded, if incurred.

The purchase of a ticket for a laboratory can be canceled free of charge within 10 working days of the event. From 10 to 5 days before the event a cost of 50% will be applied. After this deadline the cost of participation will be charged in full.

Notification

Libellula may send notification by means of a general notice on the Services, by e-mail to the email address in your Account. You can notify Libellula by written communication to the address of Libellula di Martina Bodini in Corso di Porta Romana, 74, 20122, Milan, Italy.
